Types of Product Defects
The main characteristic of personal injury cases is that a person’s or entity’s negligence caused harm or even death to another. One type of personal injury law involves product liability, which is when negligence on behalf of the design team, manufacturer, or marketing department results in needless injury to an innocent consumer. You should be able to trust the products you purchase when they are used in the designated manner.
There are three main types of product defects which can lead to personal injuries: design flaws, manufacturing defects, and misleading labeling. With design flaws, a product is flawed before it is even created. This is because the design plan for the product may be inherently dangerous, such as a car that is made with an incredibly lightweight frame can cause it to crumple and crush passengers upon any type of impact. Design flaws affect all products created from the original plan.
Manufacturing Defects and Misleading Labeling
Next, manufacturing defects typically affect only certain groups or batches of a product. These types of abnormalities often happen when unsafe materials are used to create an item. For example, a group of children’s toys can be created with lead paint, which only affects the batch made in the manufacturing facility using the lead-based paint.
Lastly, misleading labeling is also called “failure to warn.” This occurs when the marketing team or other part of the company improperly labels a product. Failure to warn can include forgetting to inform a consumer about a dangerous chemical contained in the product or failing to warn of tiny pieces that can choke young children.
