There have been new legal developments out a horrific February car accident in central missouri.
Marty Wilcox, his wife Elisa and the couple’s 3-year-old son Marty were killed February 28 in a head on collision on Highway 52 at Brown Road in Miller County.
The only survivor in the family’s car, was the couple’s baby boy, Gabriel, born just two days before.
Now the mother of Marty Wilcox Sr., has filed a wrongful death lawsuit.
Mary Robinson filed the lawsuit against 19-year-old Emily Frakes on March 19 in miller county.
The Highway Patrol said Frakes crossed the center line on Missouri Highway 52 and hit the Wilcox family head on.
Court documents say Frakes was speeding at the time.
Robinson’s lawsuit claims the teen was careless and negligent.
Robinson said because of that, not only has she lost 3 members of her family, she’s also had to take care of funeral and burial expenses.
The documents also say baby Gabriel will always suffer the loss of his parents and older brother and say the newborn was physically hurt in the crash but the extent of his injuries are unknown.
Robinson claims Frakes was cited for speeding days before the crash and say she showed a conscious and reckless disregard for others.
Baby Gabriel is now in the custody of his mother, Elisa Wilcox’s parents.

The family of a man who died after he was paralyzed when a skydiving plane crashed settled a wrongful death case a few days before trial was to begin for more than $3 million.
Steven Parrella was a cameraman aboard the plane to record other skydivers, explained his family’s attorney, Morry Cole, of Gray, Ritter & Graham in St. Louis.
The plane crashed near Sullivan, about 70 miles southwest of St. Louis, after it experienced engine failure. Six of the eight people aboard died in the crash.

On the day jury selection was to begin in a wrongful death lawsuit in the case of a 16-year-old St. Joseph boy who died when he was hit by a school bus , a multi-million dollar settlement was reached.
Mason Adams was s truck by a First Student Inc., school bus on Nov. 15, 2010 when walking to school. He was about three-tenths of a mile from Lafayette High School, where he was a junior.
Mason’s mother filed the wrongful death lawsuit against First Student and the bus driver, and were awarded a $5 million judgment on Monday.
In First Student taking responsibility for Mason’s death, his mother, Bridget Blasi, got what she really wanted, according to an email from her attorney.
Blasi spoke with 41 Action News Reporter Beth Vaughn in front of the Buchanan County Courthouse. She said, “I had been waiting on an apology. I had been waiting on them to say ‘We’re responsible for your son’s death.’ Today, they finally said that.”
Blasi is hoping to use the settlement money to build a baseball park in St. Joseph and to continue a scholarship fund in Mason’s name.
She explained tearfully, “Mason was #24. He was a competitive baseball player and he loved baseball.”
Blasi imagined what Mason might say to her now, saying, “You did it Mom. You fought for me and for what’s right and I’m so proud of you.”
We did some checking, and the St. Joseph School District pays First Student about three million dollars per year for its service. The company owns 60,000 buses nation-wide that is uses in 42 states.
Video was released for the first time Monday showing the bus driver, Tracey Jones, entering a fogged and frosted bus. The video shows Jones leaving the bus barn before clearing the windows. Shortly thereafter, Adams was struck and killed.
Attorney Michael Kuckelman explained what he’s argued for the past year, “A bus driver driving a 26,000 pound bus down the streets of St. Joseph with frost or dew on the windows, when she can’t see out, is like a 26,000 pound missile going down St. Joseph Avenue.”
He continued, “I think the amount of the settlement speaks volumes to how bad the case was.”
The St. Joseph School District tells 41 Action News it’s undecided if First Student will provide its transportation next year. The district is in the midst of a bidding process that is slated to end next week.
First Student refused to comment on the settlement.

A Macks Creek woman suffered serious injuries, but no one on a school bus was injured in a two-vehicle crash this afternoon in Camden County, the Missouri Highway Patrol reported.
Tiffany Cochran, 24, was flown to St. John’s Hospital in Springfield after the 3:35 p.m. collision on Route N just north of Hofrichter Drive.
Cochran was injured when the southbound 2001 Chevrolet she was driving crossed the center line of the road and hit a school bus driven by Shelly C. Carrick, 44, of Macks Creek head-on.
There were no injuries on the bus, according to the patrol.

David W. Melcher, whose age was not available, from Anderson, S.C., was flown to St. John’s Hospital after the 9:30 p.m. crash on Missouri 5 four miles south of Hartville. Ben H. Arnall, 88, of Hartville, also was flown to the Springfield hospital.
Two passengers in Arnall’s car, Ike G. Moore, 58, and Patsy A. Moore, 52, both of Hartville, were taken to the hospital by ambulance with moderate injuries.
The crash occurred when Melcher’s southbound 1995 Jeep crossed the center line and collided head-on with Arnall’s 2007 Buick, according to the patrol.

A 15-year-old girl from Miller County was killed in a two-car collision seven miles north of Mount Vernon Wednesday evening.
The Missouri Highway Patrol said the crash occurred around 5:15 p.m., on Highway 96, seven miles north of Mount Vernon.
Driver Daniel Freeman, 35, of Miller, was headed east when he tried to pass another vehicle. Freeman lost control and slid off the left-hand side of the road.
A pickup truck driven by Ethan Dade, 19, of Mount Vernon, swerved to avoid a crash, but hit Freeman’s car.
Teenager Kayla Freeman, a passenger in the the car, was killed.
Another passenger, 14-year-old Nicholas Freeman was transported to St. John’s Hospital in Springfield for moderate injuries, the patrol said. Both passengers were from Miller, according to the patrol.
This was the 100th fatality this year for the patrol’s Troop D.

A 15-year-old girl from Miller County was killed in a two-car collision seven miles north of Mount Vernon Wednesday evening.
The Missouri Highway Patrol said the crash occurred around 5:15 p.m., on Highway 96, seven miles north of Mount Vernon.
Driver Daniel Freeman, 35, of Miller, was headed east when he tried to pass another vehicle. Freeman lost control and slid off the left-hand side of the road.
A pickup truck driven by Ethan Dade, 19, of Mount Vernon, swerved to avoid a crash, but hit Freeman’s car.
Teenager Kayla Freeman, a passenger in the the car, was killed.
Another passenger, 14-year-old Nicholas Freeman was transported to St. John’s Hospital in Springfield for moderate injuries, the patrol said. Both passengers were from Miller, according to the patrol.
This was the 100th fatality this year for the patrol’s Troop D.

An Amish teenager has died after he was involved in an accident near Seymour last week.The Missouri Highway Patrol said 18-year-old Peter Zook was declared dead at St. John’s Hospital shortly before 5 p.m. Friday. The patrol said Zook was driving a buggy Wednesday on Route O north of Seymour, when he was struck from behind by an SUV driven by Loin D. Baker, 87, of Seymour. Zook was taken by helicopter to St. John’s Hospital.

A mother has filed a wrongful death lawsuit against First Student Inc., a bus company, after a bus driver struck and killed her teenager.
The northwest Missouri bus driver plead guilty to careless and imprudent driving after the accident. The driver admitted to failing to yield to a right-of-way at a crosswalk and striking the 16-year-old.
The teenager was later pronounced dead at the hospital. For the misdemeanor plea, the bus driver received two years probation, 15 days of shock detention, and 200 hours of community service.
