Bugaboo Americas has issued a nation-wide recall involving over 10,000 units of the Cameleon3 stroller model, due to a potential fall hazard caused by the carrying handle detaching while the removable seat is being carried. Bugaboo has received 16 reports of handles breaking, none of which have resulted in injury. Strollers included in the recall have serial numbers from 19010 11153 00001 to 19010 51248 00215. Serial numbers are printed on a horizontal bar of the stroller’s chassis beneath the seat. 9,200 of these were sold in the U.S. and 960 in Canada. In order to remedy the situation, Bugaboo is recommending consumers immediately remove the carry handle from the stroller’s bassinet or seat and contact Bugaboo for a free replacement handle. While awaiting the replacement handle, consumers can continue to use the seat or bassinet when attached to the chassis but should not attempt to use the seat or bassinet separate from the chassis.

Rescue personnel were dispatched to a downtown Kansas City business, ABC Tire Recycling, where a man was said to have fallen into one of the tire shredders on the premises. Upon arrival, they found that the man had been pulled from the machine by coworkers and was in critical condition. The victim was performing maintenance on the shredder when it spontaneously powered up and pulled him in. He was taken to a local hospital and has been confirmed to have survived, despite both main arteries being severed. While no new reports have come in today, authorities say both legs had to be amputated upon arrival at the hospital.
The Occupational Safety and Health Administration is investigating the case and hope to determine whether or not the accident was caused by a product malfunction.
In cases where the product is at fault, the manufacturer can be held responsible for damages suffered by the affected party. If you or a loved one have been made to suffer due to a manufacturing error, the personal injury attorneys at Strong-Garner-Bauer P.C. may be able to help.

Chrysler Group LLC is recalling 4,459 model-year 2013 Dodge Challenger cars to address a potential short circuit that could cause a wire harness to overheat and start a fire and took the rare step of telling owners to stop driving the affected cars immediately. About 2,500 of the cars are in owners’ hands, while the rest are still with dealers. Of the total with owners, about 2,100 were sold in the United States, about 350 in the Middle East and the rest in Canada, a company spokesman said. The recall affects only 2013 Challengers built with V-6 engines during an eight-week period ended Jan. 24, 2013, Chrysler said. Owners are advised to contact their local dealers for loaner vehicles to be paid for by the company. Chrysler will also transport the cars to dealerships to make the repairs, Chrysler spokesman Eric Mayne said. However, owners are asked not to park vehicles in or near structures, so as to lessen the risk of spreading in case of fire.

Jefferson City- Senator Bob Dixon is offering Senate Bill 64 to increase the standard of evidence needed in medical malpractice lawsuits. The bill would change the standard of evidence from a “preponderance of the evidence” to “clear and convincing.” That standard is one step below “beyond a reasonable doubt” the standard used in criminal trials. The Senate Committee on Judiciary, Criminal and Civil and Jurisprudence hearing began at 9 p.m. on Monday February 4. Strong-Garner-Bauer’s own Steve Garner, president-elect of the Missouri Association of Trail Attorneys spoke in opposition to the bill. “When we’re talking about non-economic losses, we’re talking about what makes people human,” Garner said. He went on to say that juries will interpret the higher standard to mean plaintiffs need to use document based evidence. Garner said non-economic damages such as pain and suffering are hard to prove with objection to evidence. Missouri Lawyers Weekly stated, Garner testified that the bill would make it harder for victims of negligence to recover for injuries to their quality of life. “They’re fighting a system that oftentimes is stacked against them,” Garner said. But some members of the committee said the burden didn’t seem to high. “Just because the standard is a little tighter doesn’t mean justice won’t be done,” said Sen. Rob Schaaf, R-St. Joseph and a medical doctor. “In fact, it might lead to more justice being done.” “It depends on whose ox is being gored,” Garner responded

A voluntary recall has been issued by Taylor Farms Retail Inc. for various products that could potentially be contaminated with E. coli. Two of the products shipped to Missouri specifically are the 5 oz. and 16 oz. Organic Baby Spinach trays, though other states are affected. The Taylor Farms website has not recieved any reports of illness at this time, but if you have experienced complications relating to these products, seek medical attention immediately.
Escherichia coli, or E. coli, is an extremely diverse group of bacteria found in most human and animals’ intestinal tracts. Only a few of these varieties are referred to as ‘Shiga toxin-producing E. coli’ or STEC, the pathotype most commonly heard about in the news. Anyone can be infected, though young children and the elderly are more likely to develop severe illness. Symptoms of a STEC infection range from mild stomach cramps to diarrhea and vomitting. More serious cases can lead to potentially life-threatening kidney failure known as Hemolytic Uremic Syndrome (HUS). Signs that a person may be developing HUS include fatigue, decreased urination, and loss of color inside cheeks and lower eyelids. Most people suffering with HUS recover within a few weeks, but some may suffer permanent damage or even death. If you or a loved one have come into contact with any of the above products and think you may be suffering from either a STEC infection or HUS, the personal injury attorneys at Strong-Garner-Bauer P.C. can help. In the last month, multiple U.S. food-processing companies have been forced to recall various products due to possible contamination with Listeria monocytogenes, the bacterium responsible for causing Listeriosis. A few of the companies on the list are; Sprouters Northwest, GoldCoast Salads, Whole Foods Market, Knott’s Fine Foods Inc., and Delifish. The affected products range anywhere from cream cheese bagels and packaged chicken salads to cold smoked fish products and assorted sprouts, such as alfalfa, clover, etc.
Complications resulting from exposure to the Listeria bacteria are host-specific and can vary greatly from one case to the next. Most people experience symptoms commonly associated with ‘food poisoning’ such as fever and body aches, usually preceded by nausea or other gastrointestinal issues. That being said, listeriosis is considered an ‘invasive’ infection, meaning it can move beyond the gastrointestinal tract and infect other parts of the body. Those most at risk are older adults, children, and those with immunodeficient conditions. These people are susceptible to the normal symptoms as well as septicemia and meningitis in some cases. Pregnant women experience the same symptoms, but the stakes are higher as infection can also result in miscarriage, still birth, and premature delivery. Even babies that make it to term are at risk for serious infections, such as bacteremia and meningitis.
If you or someone you know have been affected by one of the products on this list, the attorneys at Strong-Garner-Bauer P.C. are here to help. Call our office at (417) 887-4300 or email info@stronglaw.com for a consultation.

Ford Motor Company has recalled its 2013 Escape Utility Vehicle, for the third time. Strong-Garner-Bauer’s own Grant Rahmeyer was featured on a recent news story reguarding generic and name brand prescription drugs not being held to the same standards.
Should generic drug makers be held to the same standard as name brand drug makers? According to the Supreme Court the answer is no. That decision–made more than a year ago–is trickling down to lawsuits all over the country.
“Right now about 75-80% of all drugs are generic drugs,”said lawyer Grant Rahmeyer. Generic drugs have become popular over the years. It is partially due to
the Hatch-Waxman Act at the federal level back in the 1980′s.
“Prescription drug costs were just skyrocketing out of control. They did
everything they could to push more generic drugs out into the market. It’s been
extremely successful,” said Rahmeyer.
Many lawsuits are now being dismissed across the country dealing
with generic drug makers.
“Generic drugs are getting easier approval by proving that they are identical. If they are identical why don’t we hold them to the identical legal standard that the name brand equivalents have to go through?” asked Rahmeyer.
The Supreme Court ruling says makers of generic drugs cannot be sued for not
