What Is Kratom?
Kratom (Mitragyna speciosa) is a tropical tree native to Southeast Asia whose leaves have been used for centuries as a stimulant and painkiller. In the United States, it has become increasingly popular, marketed as a “natural” alternative to opioids, a chronic pain remedy, and even a treatment for opioid withdrawal. It is sold widely in powder, capsule, liquid extract, and concentrated “shot” form, often at gas stations and smoke shops.
Despite the “all-natural” marketing, kratom is not approved by the FDA for any medical use and is not consistently regulated as a dietary supplement. This means consumers often have no reliable way of knowing what they are taking or at what dose.
How Kratom Affects the Body and Why It Is Dangerous
Kratom’s active compounds, mitragynine and 7-hydroxymitragynine, bind directly to the brain’s opioid receptors, the same receptors targeted by heroin and oxycodone. At low doses it acts as a stimulant. At higher doses, its opioid-like effects dominate: sedation, slowed breathing, and euphoria. Regular users can develop physical dependence and experience opioid-like withdrawal when they stop, a fact routinely omitted from product labels.
Recognizing a Kratom Overdose
Because kratom products are unregulated, potency varies wildly from batch to batch. A dose that felt normal one week could be dangerously concentrated in the next purchase. Overdose symptoms can include:
- Severe confusion, agitation, hallucinations, or seizures
- Rapid or irregular heartbeat and chest pain
- Slow, shallow breathing that cuts off oxygen to the brain (respiratory depression), which is the leading cause of kratom-related death
- Jaundice, dark urine, and extreme fatigue, which are signs of serious liver damage
As of 2026, the FDA has identified 44 deaths linked to kratom use, and poison control centers have received thousands of kratom-related calls with outcomes ranging from vomiting to coma.
When the Manufacturer May Be Responsible
Kratom companies, including manufacturers, importers, distributors, and retailers, can all face legal liability when their products cause harm.
If the product had a design defect, was contaminated during manufacturing, or carried inadequate warnings about addiction and overdose risk, the manufacturer may be held liable. Multiple FDA investigations have found kratom products contaminated with heavy metals like lead and nickel, as well as Salmonella, which is clear evidence of defective manufacturing.
Deceptive marketing claims arise when manufacturers label their products “safe,” “non-addictive,” or medically validated without credible evidence to support those claims. Many states have strong consumer protection laws that allow victims to recover damages and attorney’s fees in these situations.
