Why Strong Law, P.C. for a Brain Injury Case in Southwest Missouri

Brain injury cases are won or lost on the quality of the medical and economic expert testimony assembled to document the injury’s true long-term impact. Insurance companies in TBI cases routinely retain their own neurological experts to argue that imaging is normal, symptoms have resolved, or deficits are attributable to anxiety or pre-existing conditions. Overcoming those arguments requires a firm with the resources and the experience to build an expert infrastructure that is equal to the defense.

Strong Law has been doing exactly that in Missouri for nearly 50 years.

Understanding Traumatic Brain Injury

A traumatic brain injury is any injury to the brain caused by an external force. This includes direct blows to the head, penetrating injuries, and the rapid acceleration and deceleration forces that cause the brain to strike the interior of the skull. The consequences range from a concussion that resolves in weeks to permanent, severe cognitive and functional impairment.

The brain governs every aspect of who we are: our personality, our memory, our language, our judgment, our ability to work and maintain relationships. Injury to any region of the brain can affect any of these functions. And because the brain has limited capacity to regenerate injured tissue, many TBI effects are permanent or only partially reversible through rehabilitation.

In personal injury litigation, TBIs are both among the most valuable and the most legally challenging cases to handle. Their value is high because the lifetime costs of a serious brain injury, measured in medical care, lost earning capacity, and diminished quality of life, can be enormous. Their legal challenge is significant because many TBI effects are invisible on standard imaging, making them targets for insurance company minimization. Strong Law builds the expert case that overcomes those challenges.

Types of Brain Injuries

Concussion and Post-Concussion Syndrome

A concussion is a mild TBI involving temporary disruption of brain function following a blow or jolt to the head. Many concussions resolve within weeks, but a significant percentage result in post-concussion syndrome, a prolonged condition involving persistent headaches, cognitive difficulties, sleep disturbance, emotional dysregulation, and sensitivity to light and sound. In southwest Missouri, where car crashes on I-44, US-60, and US-65 are a consistent source of head injuries, concussion cases are common, and their long-term impact is frequently underestimated by initial treating physicians and insurance adjusters alike.

Diffuse Axonal Injury

Diffuse axonal injury (DAI) is caused by the shearing forces of rapid acceleration and deceleration tearing the axons (the communication fibers between neurons) throughout the brain. It is one of the most common types of severe TBI and is a leading cause of vegetative states and severe permanent disability following high-speed motor vehicle accidents. DAI is frequently invisible on standard CT and MRI scans, even when the functional impairment is severe, making expert neuroimaging interpretation critical to documenting the injury.

Brain Contusion

A cerebral contusion is a bruise on the brain itself, occurring when the brain strikes the inside of the skull during impact. Contusions cause localized damage to specific brain regions and can be accompanied by bleeding, swelling, and elevated intracranial pressure. The location of the contusion determines which functions are affected, with frontal lobe injuries affecting judgment and impulse control, temporal lobe injuries affecting memory and language, and occipital lobe injuries affecting vision.

Epidural and Subdural Hematoma

Hematomas are dangerous collections of blood that compress the brain. An epidural hematoma develops between the skull and the brain’s outer membrane and can cause rapid neurological deterioration if not surgically evacuated. A subdural hematoma develops beneath the outer membrane, above the brain surface, and may be acute or chronic. Both types carry significant risk of permanent brain damage and death if not promptly recognized and treated.

Intracerebral Hemorrhage

Bleeding within the brain tissue itself can occur as a direct result of trauma or from the secondary effects of impact on blood vessel walls. This type of injury can cause immediate severe neurological deterioration and carries high mortality and morbidity rates.

Anoxic and Hypoxic Brain Injury

When the brain is deprived of oxygen, neurons begin dying within minutes. Anoxic and hypoxic brain injuries can result from near-drowning in the lakes and rivers throughout the Ozarks region, cardiac arrest following traumatic injury, severe blood loss, airway obstruction in accident victims, and medical errors that interrupt oxygen delivery. These injuries may be legally actionable against negligent property owners, recreational facility operators, or healthcare providers depending on the circumstances.

Common Causes of TBI in Southwest Missouri

The causes of traumatic brain injury in personal injury cases in southwest Missouri include:

  • Motor vehicle accidents on I-44, US-65, US-60, and the rural Ozark road network, where high-speed collisions with trucks, other vehicles, and fixed objects produce severe TBIs. The Branson tourist corridor on US-65 generates significant accident volume from unfamiliar drivers.
  • Motorcycle accidents, where riders lack the structural protection of a vehicle and face catastrophic head injury risk even at moderate speeds. Missouri law requires helmets only for riders under 26, and unhelmeted riders over 26 face disproportionate TBI risk.
  • Construction accidents in Springfield’s active construction market, where falls from heights, struck-by incidents, and caught-in accidents cause a significant share of workplace TBIs.
  • Falls on premises, including slip and fall accidents on commercial properties, residential properties, and in retail and hospitality environments throughout the Springfield metro area and Branson corridor.
  • Agricultural equipment accidents on Missouri farms, where tractor rollovers, PTO entanglements, and equipment falls cause both traumatic and hypoxic brain injuries.
  • Boating and water recreation accidents on Table Rock Lake, Lake Taneycomo, Bull Shoals Lake, and other Ozark water bodies, where falls, collisions, and near-drowning events cause TBIs.
  • Defective product failures, including vehicle safety system failures, defective helmets, and unsafe equipment that allows head impact to occur.
  • Assaults and intentional violence, which can give rise to civil claims against perpetrators and against negligent property owners who failed to provide adequate security.

Recognizing the Symptoms of a Traumatic Brain Injury

TBI symptoms often do not appear immediately or in their full severity at the scene of an accident. This is one of the most important reasons to seek thorough medical evaluation after any significant head injury, even when initial symptoms seem mild. Symptoms that may indicate a traumatic brain injury include:

Physical Symptoms

  • Loss of consciousness or a period of confusion at the time of injury
  • Persistent or worsening headache
  • Nausea, vomiting, or dizziness
  • Seizures or convulsions
  • Slurred speech or difficulty communicating
  • Weakness or numbness in the limbs
  • Fatigue and disrupted sleep
  • Fluid from the nose or ears following head trauma

Sensory and Perceptual Symptoms

  • Blurred or double vision
  • Sensitivity to light and sound
  • Ringing in the ears (tinnitus)
  • Changes in smell or taste

Cognitive and Behavioral Symptoms

  • Memory problems and difficulty forming new memories
  • Difficulty concentrating or following conversations
  • Slowed processing speed and word-finding difficulties
  • Significant personality changes, including increased irritability or emotional outbursts
  • Depression, anxiety, or mood swings
  • Poor judgment and impulsivity
  • Loss of insight into one’s own deficits, which is particularly common with frontal lobe injury

Family members and close friends often notice changes in the TBI victim’s cognitive function and personality that the victim themselves does not recognize. This is a critical source of evidence in brain injury litigation, and Strong Law works with families to document these changes carefully throughout the case.

Why Brain Injury Cases Are Legally Challenging

TBI cases present specific challenges that distinguish them from standard personal injury claims, and that make the choice of attorney particularly important.

The Problem of Invisible Injuries

Standard CT and MRI scans frequently appear normal even in victims with significant TBI. Diffuse axonal injury, in particular, is structurally invisible on conventional imaging despite causing severe and permanent functional impairment. Defense experts routinely exploit this, arguing that normal imaging means minimal injury. Strong Law counters this with specialists in advanced neuroimaging, including diffusion tensor imaging (DTI), and comprehensive neuropsychological testing that objectively documents cognitive and behavioral deficits regardless of what standard imaging shows.

Documenting Future Costs

The most significant component of a serious TBI case is often the future cost of care and the loss of earning capacity extending decades forward. Accurately calculating these numbers requires life care planners, vocational rehabilitation experts, and forensic economists. Without this expert infrastructure, settlement demands dramatically undervalue the case. Strong Law builds this analysis for every serious TBI case before any settlement demand is made.

Handling Defense Arguments About Pre-Existing Conditions

Insurance companies frequently argue that TBI symptoms are attributable to pre-existing anxiety, depression, ADHD, or prior head injuries. Missouri’s eggshell plaintiff doctrine holds that a defendant takes their victim as they find them: if a pre-existing condition made the victim more vulnerable to TBI, or if the accident aggravated an existing condition, the defendant is still fully responsible for all resulting harm. Strong Law anticipates and specifically prepares against pre-existing condition arguments in every TBI case.

Timing: Why Early Action Matters

Brain injury cases require early, careful documentation of the injury’s evolution. Neuropsychological testing conducted shortly after injury creates a baseline against which later testing can demonstrate the persistence or progression of deficits. Family and colleague observations recorded early are more persuasive than recollections developed years after the fact. And early retention of treating neurologists and rehabilitation specialists creates a medical record that tells the full story. Waiting to seek legal counsel in a TBI case consistently results in weaker documentation and lower recoveries.

Who May Be Held Liable for a Brain Injury in Southwest Missouri?

Liability in a TBI case is determined by the circumstances of the injury. Depending on the facts, responsible parties may include:

  • A negligent driver, in car, truck, or motorcycle accident cases on I-44, US-65, US-60, or any other Missouri road
  • A trucking company, for their driver’s negligence or their own failures in hiring, supervision, or vehicle maintenance
  • A property owner, in slip and fall or premises liability cases where a dangerous condition caused a fall resulting in TBI
  • A general contractor or subcontractor, in construction accident cases involving OSHA violations or inadequate fall protection
  • A product manufacturer, in cases where a defective vehicle safety system, helmet, or piece of equipment contributed to the brain injury
  • A healthcare provider, in medical malpractice cases involving surgical errors or failure to diagnose and treat a brain bleed
  • A property or venue owner, in boating or water recreation accidents on Ozark lakes and rivers where negligent operation or inadequate safety precautions caused the injury
  • A government entity, for dangerous road conditions, defective traffic controls, or inadequate safety measures on public property

Compensation Available in a Missouri Brain Injury Case

Economic Damages

  • All past medical expenses, including emergency care, neurosurgery, ICU, inpatient rehabilitation, and all subsequent treatment
  • Future medical costs, potentially spanning decades, including neurological care, psychiatric treatment, cognitive rehabilitation, and medications
  • Life care costs for personal assistance, home modification, and supportive services if the TBI has reduced functional independence
  • Lost wages for time missed from work
  • Loss of future earning capacity, which in cases involving professionals or skilled workers can represent the most substantial component of economic damages

Non-Economic Damages

  • Pain and suffering
  • Emotional distress and psychological harm
  • Loss of enjoyment of life
  • Permanent cognitive, behavioral, and personality changes
  • Loss of consortium

Wrongful Death

When a TBI is fatal, surviving family members may pursue wrongful death claims for funeral expenses, lost financial support, loss of companionship, and the grief caused by the loss.

Punitive Damages

When the brain injury resulted from especially reckless or egregious conduct, such as a drunk driver or a manufacturer that concealed a known safety defect, punitive damages may be available in addition to compensatory recovery.

How Strong Law Builds a Brain Injury Case in Southwest Missouri

The expert infrastructure required to win full value in a serious TBI case is the same regardless of where the injury occurred. Strong Law’s approach includes:

  • Retaining neurologists and neuropsychologists who conduct comprehensive neuropsychological testing to document cognitive, behavioral, and functional deficits objectively
  • Working with advanced neuroimaging specialists to document structural and functional brain changes that standard imaging misses
  • Engaging life care planners to develop comprehensive analyses of future medical and personal care needs
  • Retaining vocational rehabilitation experts to document the impact of TBI on employment and earning potential
  • Using forensic economists to translate future cost projections into present-value damages calculations
  • Building family and witness testimony documenting pre- and post-injury cognitive and behavioral function
  • Preparing specifically against defense neurological expert testimony and the pre-existing condition and normal imaging arguments they will raise

This preparation takes time, and beginning early makes the case stronger. The longer the documented history of symptoms, the more powerful the evidence that those symptoms are real, persistent, and caused by the accident.

Frequently Asked Questions: TBI Cases in Southwest Missouri

Does normal imaging mean I do not have a brain injury?

No. Normal CT and MRI scans are consistent with, and in fact expected in, many significant TBI cases, including most diffuse axonal injuries and post-concussion syndrome cases. Standard imaging was not designed to visualize the microscopic axonal damage and functional connectivity disruptions that characterize many TBIs. Advanced imaging and neuropsychological testing can document the injury regardless of what standard scans show.

My doctor said my concussion should resolve in a few weeks, but it has been months. What should I do?

This is classic post-concussion syndrome, a prolonged condition that affects a significant percentage of concussion patients. It is a recognized medical condition with objective, documentable features, and it forms the basis of a valid personal injury claim even when standard imaging is normal. Seek evaluation from a neurologist or neuropsychologist and contact Strong Law to discuss your legal options.

The other driver’s insurance company offered a settlement quickly. Should I accept?

Not before consulting an attorney. Early settlement offers in TBI cases are almost always designed to close the claim before the full long-term impact is known. Once you sign a release, you cannot recover additional compensation regardless of how your condition evolves. Let Strong Law evaluate the offer against the documented and projected long-term costs of your injury.

Can I pursue a claim if I was also collecting workers’ compensation?

Yes. Workers’ compensation covers TBIs sustained on the job but is limited to medical expenses and a portion of lost wages. It does not compensate for pain and suffering or the full value of lost earning capacity. More importantly, workers’ compensation does not bar personal injury claims against third parties who are not your direct employer. Strong Law evaluates all available recovery avenues in every workplace TBI case.

What does hiring Strong Law cost?

Nothing upfront. All brain injury cases are handled on a contingency fee basis. You pay no attorney’s fees unless and until we recover compensation for you. Your first consultation is always free.
